About this policy

1.1

Any company car SY Plus Limited provides as part of the employee’s contract will remain the organisation's exclusive property and may be used by only you subject to the organisation's policy in force from time to time.

1.2

SY Plus Limited reserves the right to determine the value, make and model of the car to be provided to the employee and to change, vary or withdraw the employee's allocated car at any time for any reason. In practice, however, the organisation will endeavour to consult each employee with a view to offering a reasonable choice as to the make, model and colour of the car to be allocated. Replacements for company cars will be entirely at SY Plus Limited discretion.

1.3

If, for any reason, the employee is suspended from work, is placed on garden leave or is working out a period of notice, the organisation reserves the right to withdraw.

1.4

the employee's company car and pay an allowance equivalent to the value of the normal use of the car instead.

Conditions of entitlement

2.1

The provision of a company car is subject to the employee holding and continuing to hold a current, full driving licence. Before being allocated a company car, the employee must show proof that they hold a valid driving licence. We will retain a copy of the employee's driving licence for the period that they are provided with a company car.

2.2

It is also a condition of being allocated a company car that the employee declare to the organisation any current driving convictions or penalty points received. The employee is also required to notify SY Plus Communications in writing of any motoring offences (including parking tickets) with which they or their partner/any family member who is authorised to drive the car have been charged or convicted. SY Plus Communications will periodically check the driver's status through the gov.uk checking service.

2.3

Employees must comply with all relevant traffic laws and rules. If you incur driving fines, including parking tickets, the responsibility for paying these (and any fines for non-payment) rests with you. Disciplinary action will be taken against any employee who incurs fines or penalties that are either not declared or not paid.

2.4

There is a £20 administrative fee for each fine the business pay’s on the employees behalf.

Use of the company car

3.1

SY Plus Limited permits employees who are allocated a company car to use it for personal purposes as well as on organisation business.

3.2

Any company car provided may be driven by the employee and other approved designees.

3.3

If the employee wishes to take the company car overseas for either business or personal use, prior written authorisation must be obtained from a Director. You are required to give at least one month's notice of any request to take the car overseas.

3.4

No person under the age of 21 will normally be permitted to drive a company car (except where the organisation has expressly authorised an employee under 21 to drive organisation vehicles).

3.5

The only exception to the above principles will be in a genuine emergency, in which case any licensed driver may drive the company car.

3.6

Company cars may not under any circumstances be used for any of the following purposes:

(a)

Racing or rally driving;

(b)

Hire or reward; and

(c)

Driving tuition of any kind, including tuition of family members.

3.7

Any use of alcohol or drugs (prescribed or otherwise) while in charge of a company car, where that alcohol or drug use has any potential effect on your fitness to drive, will result in disciplinary proceedings.

3.8

SY Plus Limited does not permit employees to smoke in any company car, under any circumstance, either as a driver or passenger. Please see our smoking policy for further guidance.

3.9

It is a criminal offence to drive a motor car while using a "hand-held" mobile phone. This includes sitting in a stationary car with the engine running. You may use a hand-held phone only if you are parked safely and the engine is not running or you need to call 999 in an emergency and it is unsafe or impractical to stop. For all other telephone usage, employees must have hands-free access.

3.10It is a criminal offence to smoke in a car, or other vehicle, when someone under the age of 18 is present

Maintenance of the company car

4.1

The expense of taxing, insuring, MOT testing, repairing, maintaining and in so far as attributable to the use of the car for the purposes of SY Plus Limited business, running the car, including any congestion charge incurred, will be borne by us. Fuel should be purchased by the employee and reclaimed in line with our Business expenses policy.

4.2

It is a condition of the provision of a company car that the employee ensures that the car is maintained in a safe and roadworthy condition at all times, complying with all existing legal requirements. The employee is therefore responsible for:

(a)

checking all lubricants on a regular basis;

(b)

checking tyre pressure and treads regularly;

(c)

checking all lights regularly;

(d)

cleaning the car internally and externally on a regular basis;

(e)

submitting the car for service as requested by the organisation.

Data Protection

5.1

SY Plus Limited processes personal data collected in the course of the operation of the company car policy in accordance with its data protection policy. Further details of which can be accessed from the compliance team.
